1. Introduction


1.1. This service consists of a tourist entertainment activity, in which off-road tours are carried out on pre-established itineraries, in European category T1, T2, T3, L6e and L7e vehicles, commonly known as buggys/buggies and quadricycles/quad bikes, in which the customer rents and drives the vehicle for a certain period of time and pre-contracted price, accompanied by a Guia-Monitor.


1.2. In the context of any question or matter not addressed, the customer should not make a reservation, proceeding with the request for clarification through the available contact channels.


1.3. By booking, the customer is accepting and consenting to the Terms and Conditions

2. Definitions


2.1. “Guia-Monitor” - collaborator of the service provider (hereinafter

referred to as “Monitor”).

3. Requirements


3.1. The minimum age for participation as a companion is 6 years or 1 meter tall, provided that you are accompanied by an age of majority and the document “Authorization and Disclaimer for Minors” has been completed.


3.2. For contractual purposes, on the day of the activity, drivers must connotatively

and compulsorily present:

3.2.1. Valid legal identification document.


3.2.2. Valid light vehicle driving license (category B).


3.2.3. Age of majority.


3.2.4. address.


3.3. It is mandatory to provide a deposit of 200€ (two hundred euros)

with a bank card for each vehicle.

3.3.1. Without the provision of a deposit, the activity is not carried out, implying the loss of the total amount of the reservation.


3.3.2. The security deposit is a monetary guarantee to the service provider, and is withheld in the event of losses caused by the customer. The bond is not a deductible.


3.3.3. Regardless of whether or not the individual driver causing the loss is the holder of the security, it is withheld

.

3.4. The driver must unconditionally complete and sign a liability statement, solely and exclusively for the purposes of the contractual relationship.


3.5. The customer must unconditionally complete and sign a liability notice when accompanied by minors, solely and exclusively for the purposes of the contractual relationship.


3.6. The driver unconditionally accepts the reproduction in a copy of the identification document and driving license, solely and exclusively for the purposes of the contractual relationship.


3.7. The customer must recognize the meteorology present at the location and date of the activity, using legal information media (Portuguese Institute of the Sea and the Atmosphere).


3.8. The customer must wear clothing appropriate to the activity, especially comfortable and susceptible to exposure to dust, mud, water, and predominantly cold weather.


3.9. The service provider unconditionally records the audiovisual activity exclusively for contractual compliance purposes.


4. Dynamics of the activity


4.1. The customer drives the contracted vehicle.


4.2. Customers can alternate driving, with the obligation to inform at the start of the activity, and the Monitor determines the driver exchange points.


4.3. The activity is always accompanied by a specialized monitor that indicates the route to follow, who may share the customer's vehicle depending on the capacity or technical need, or not.


4.4. During the entire activity, there is only one (1) stop with a maximum duration of 5 minutes (photographic record).


4.5. Other customers (independent vehicles) may participate in the activity and is not an exclusive activity.


4.6. During the activity, it may be subject to change for technical, operational, meteorological or other reasons, and may be postponed or canceled with a full or partial refund of the amount paid.


4.7. The service provider performs the audiovisual recording of the activity with a view to broadcasting for promotional purposes, and the customer must express his opposition to the registration, if he does not wish to do so

5. Risks


5.1. Risk of failure, accident, injury, trauma, and death.


5.2. Risks inherent to pregnancy, mental problems, body structure, postoperative periods, asthma, hypothermia, and others, which may be the result of vibrations, impacts, dust, low temperature, humidity, and others caused by the characteristics of the activity and associated lack of care.


5.3. The client may get wet, dirty, or damage clothes or other belongings, due to the characteristics of the activity and associated lack of care.


5.4. Accident, if the instructions given by the Monitor are not followed and the vehicle is driven defensively and diligently;


5.5. Skewing/rollover in curves/turns, aquaplaning that can occur when the driver is driving recklessly;


5.6. Injuries caused by approaching fences, walls, branches, among others;


5.7. Other injuries resulting from improper conduct, especially due to non-compliance with global safety regulations and instructions given by the Monitor;


5.8. The driver must make sure that people and animals are safe.


5.9. In the event of an accident, due to the characteristics of the activity, namely the itinerary in remote areas, the rescue

may be delayed.

6. Rules


6.1. Disregard for the rules of the activity can have very serious consequences.


6.2. In the context of breach of contract, disobedience or violation of the rules, the necessary measures are taken, and corrective measures may be applied, the activity suspended with the total loss of the amount paid, with the loss of the security due to any loss caused, and even the activation of the authorities.


6.3. In the context of the existence of children or the elderly in the activity, who are characterized by their physical and psychological fragility, there is zero tolerance for risky behavior.


6.4. If the monitor is lost, the customer must immediately immobilize the vehicle and wait for the Monitor to arrive, in order to proceed with the regularization of the activity.


6.5. It is prohibited to

:

6.5.1. while driving:


6.5.1.1. perform dangerous maneuvers such as drifts, drifts, pions, jumps, sudden accelerations, unnecessary sudden braking, overtaking, irregular driving, zigzags, among others.


6.5.1.2. drive in a dangerous, destructive, uncontrolled manner.


6.5.1.3. exit the rail/path common to the Monitor.


6.5.1.4. exit the original normal formation.


6.5.1.5. exiting the vehicle without authorization.


6.5.1.6. violate the highway code.


6.5.1.7. use other vehicle instruments except accelerator, foot brake, belt, steering wheel, lights, turn signals and horn. The use of instruments other than those authorized may cause serious damage to the vehicle, for which the driver will be held responsible. (see 7.)


6.5.1.8. stop without authorization.


6.5.1.9. stop parallel to other vehicles.


6.5.1.10. change the driver without authorization from the Monitor.


6.5.1.11. honk horns at people or animals.


6.5.1.12. carry out self-reasoning initiatives parallel to the terms and conditions, which are susceptible to prejudice, without authorization from the Monitor.


6.5.1.13. accelerate before the curve/turn and during the curve/turn, at the risk of skidding, rollover, or accident caused by centrifugal force, associated with the characteristics of the vehicle and the terrain.


6.5.1.14. reverse gear, or in other words, travel in reverse, and are susceptible to a serious accident.


6.5.2. the practice of any ethical or civic irregular behavior towards people, animals or the environment (third parties).


6.5.3. consume alcoholic beverages, narcotic substances, smoke, fire or fire, leave garbage or waste on the route.


6.5.4. approach or disturb animals.


6.6. It is mandatory to:


6.6.1. Respect the rules of the activity and orders of the Monitor.


6.6.2. Use a seat belt.


6.6.3. Follow the Monitor's trajectory.


6.6.4. Always keep the vehicle in the center of the rail, and going off the track can have very serious consequences.


6.6.5. Respect people and animals (third parties), pass slowly, stop if necessary.


6.6.6. In the event of an accident, rollover, damage, noise, smell, or abnormal smoke from the vehicle, the driver must immediately immobilize the vehicle and alert the Monitor by ringing the horn 3 times followed by the horn.


6.6.7. If the vehicle becomes stranded/stuck, the driver must immobilize the vehicle and alert the Monitor. Failure to comply with this rule may result in serious damage to the vehicle.


6.6.8. Clarify any existing questions before starting the activity

7. The sole responsibility of the driving customer


7.1. The driver is responsible for the vehicle and occupants and must adopt diligent, defensive and prudent driving.


7.2. The driver is responsible for any damage and/or loss resulting from driving or misuse.


7.3. The driver is responsible for any damage to the vehicle that results from driving or misuse.


7.4. The driver is responsible for any damage to the vehicle that results from the improper and prohibited use of the vehicle's control instruments, taking into account paragraph 6.5.1.7.


7.5. The driver must compensate the service provider for the losses resulting from the repair of the vehicles and the consequent suspension of their activity, in an amount never less than 140€ per day.


7.6. The driver is responsible for paying offenses that result from driving, negligence, or violation of the rules provided for in the Highway Code.


7.7. The service provider is not responsible for the loss, damage, or theft of personal property, and the customer must ensure adequate protection for them.


7.8. The customer must be accompanied during the identification document and driving license activity.


7.9. The driver must practice defensive driving, and maintain a safe distance between vehicles, being blamed for the collision with the vehicle ahead

8. Itinerary


8.1. The itinerary consists of an all-terrain route, consisting of dirt roads, forest roads and road roads.


8.2. The itinerary is pre-defined by the service provider depending on the contracted period of time.


8.3. Route maps are available for consultation at the service provider's facilities, with the respective geographical references

9. Vehicles


9.1. The vehicles are of the European category T1, T2, T3, L6e and L7e, commonly known as buggys/buggies and quadricycles/quad bikes.


9.2. The vehicles are rear-wheel drive, and 4-wheel drive may or may not be activated.


9.3. The vehicles are fully open and contain no guards

10. Schedule


10.1. The activity is regulated by a fixed time schedule, and there is no time flexibility.


10.2. There is no time tolerance, and the customer must be present at the stipulated time.


10.3. The time period of the itinerary is calculated based on an average speed, and may naturally be shortened or lengthened by the driver's driving behavior, giving rise to slight differences in the contracted period of time.


10.4. Taking into account the previous point, the customer accepts a delay of 60 minutes after the start time of the activity.


11. Reserva


11.1. The reservation must be made as soon as possible.


11.2. Reservations are only accepted via online platforms and may eventually be accepted by other established sales channels, such as vouchers.


11.3. The service is prepaid.


11.4. In the event of a customer's no-show, there is no refund.


11.5. If canceled by the customer within 48 hours prior to activity, there is no refund.


11.6. Upon cancellation by the customer in a period exceeding 48 hours prior to activity, the refund is full.


11.7. The service provider has the right to cancel the activity at any time, based on weather conditions, technical conditions (vehicles and human resources), or any other reason that justifies or proves harmful to one of the parties, giving rise to rescheduling, partial or full reimbursement.


11.8. The refund period is 3 to 5 days (Stripe)
